What is eDiscovery?
Discovery is the term used for the initial stages of litigation were the parties involved decide on the terms of the case. In 2006 amendments to the Federal Rules of Civil Procedure (FRCP) further detailed the requirements around the discovery of electronically stored information (ESI). The changes to the FRCP brought about the term eDiscovery. Electronic data is different from its paper form for there is additional metadata that accompanies the data that is not found in its paper counterpart. Being able to properly document and execute the eDiscovery process the same way each time is key to a company’s defensibility, regardless of the technology used.
